Dr Tudor Chiuariu delivered a presentation within the Wolters Kluwer Public Procurement Conference on the access for non-EU bidders (CJEU, Kolin C-652/22).

Dr Tudor Chiuariu contributed as a speaker on 27.03.2025 the Conference Innovation and Transparency in Public Procurement: Challenges and Opportunities, organized by Wolters Kluwer Romania and Faculty of Law, Titu Maiorescu University, where he delivered a presentation on the topic: Access for non-EU bidders, between protectionism and unpredictability. CJEU Kolin judgment (C-652/22).

The issue of the participation of economic operators from non-EU countries is very topical for the Romanian public procurement market, given the significant percentage of bidders who have won high value public procurement contracts in recent years, especially from Turkey. Recent CJEU case law provides important clarifications on the conditions under which EU public procurement authorities can refuse or allow such operators to participate in tender procedures and the conditions under which such participation can take place, i.e. without being treated at least equally with EU economic operators or their assimilated.

The conference brought together academics, judges, attorneys-at-law and legal counselors with expertise in public procurement.
