CJEU ruled in Case C-40/21 National Agency of Integrity, following a request for a preliminary ruling raised by Chiuariu & Associates.

CJEU ruled that the sanctions for incompatibilities and conflict of interests in the public sphere must respect the principle of proportionality. The CJEU imposed that national courts must analyse the legality of the applied penalties, including their proportionality. The CJEU ruled that when the breach is not serious, the corresponding penalties must be set aside.
