Drd. Vera Ciochină is counsellor at Chiuariu & Associates – Attorneys at Law. Her main areas of expertise are corporate affairs, labour law and tax law, with a special focus on transfer prices planning and assistance.

Her approach is hands-on, aims at practical solutions and building trust relationships with clients.

She participated in energy and real estate projects by drafting legal analyses, assisting clients both in the negotiation and conclusion of various types of contracts.

Vera obtained her Master’s degree in Administrative and Tax Litigation from the Faculty of Law of the West University Timisoara (2022). She also obtained a postgraduate degree having as subject matter the Administrative Code with the Faculty of Law of the University of Bucharest (2023).

She is currently drafting a PhD thesis on disciplinary liability within the Doctoral School of the Faculty of Law, University of Bucharest, and an associate assistant professor at the Faculty of Law of the Titu Maiorescu University, Bucharest.

Also, she is a member of the Institute of Administrative Sciences „Paul Negulescu” of Romania.

Vera has acquired specialized training in Construction Law by attending the courses of FIDIC Academy.

Vera speaks Romanian, English, Spanish, and Russian.

Administrative-disciplinary misconducts and sanctions under the Administrative Code (Abaterile și sancțiunile administrativ-disciplinare prin prisma Codului administrativ), Public Law Magazine – Supplement 2024.

Abstract

The Administrative Code introduces a few new elements in the field of administrative-disciplinary liability, from the introduction of new misconduct and disciplinary sanctions to the introduction of a correspondence between misconduct and disciplinary sanctions that specifies which sanctions that can be applied for each of the misconduct, depending on the seriousness of the offense.

Before the entry into force of the Administrative Code, issues related to the administrative-disciplinary liability of civil servants were regulated by Law no. 188/1999 on the Statute of Civil Servants and Law no. 7/2004 on the Code of Conduct for Civil Servants. The Administrative Code aimed to bring together all legislation on the organization and functioning of the civil service, the civil servant’s statute and the procedure of administrative-disciplinary liability of civil servants (Part VI).
